Michael Einbinder, representing a franchisor client, recently closed on the acquisition of over 20 franchise units of a franchisee in a Chapter 11 proceeding. Michael also represented the proceeding blocking the sale of the units to other parties in order to keep them in the system.

Mackenzie Dimitri won an award on behalf of a franchisee client in arbitration, utilizing the American Arbitration Association’s expedited commercial procedures in order to minimize client costs and accelerate the litigation process. A successful outcome was achieved in only five months.

Mackenzie’s presentation is titled “Enforcing the Bargain or Buying Your Way Out? The Right to Specific Performance in Franchise Agreements versus the Concept of Efficient Breach.” Jim is a member of the panel presenting the “Fundamentals of Franchising” intensive program.

Mackenzie Dimitri hosted a webinar for the American Bar Association on March 28, 2017, titled “Hot Legal Topics to Consider This Renewal Season.” Mackenzie hosted the webinar with a panel of distinguished franchise attorneys and discussed the following topics: (1) The new NASAA FPR Commentary; (2) new technological developments in the franchise industry and their regulatory implications; (3) data management and privacy issues; (4) the new SBA process; and (5) the Defend Trade Secrets Act of 2016.

Michael and Jim are each members of the “Legal Eagles Hall of Fame” having been recognized by the magazine as top attorneys in the field of franchising for 10 or more years.

Einbinder, Dunn & Goniea recently obtained a preliminary injunction on behalf of a client in the horse-drawn carriage industry requiring animal rights protesters to stop harassing and obstructing horse-drawn carriage drivers and their customers and requiring them to maintain a 9-foot buffer zone from the horse-drawn carriages when engaged in protest activities.
